1. Duty of Care
The guests have to treat the rented premises or the apartment and the furnishings with care. The guests have to compensate for culpably caused damages. Upon moving into the premises, the guests are obligated to check the furnishings for completeness and fitness for use and to immediately notify the host of any complaints. The guests must also immediately report any damage occurring during the rental period. If the guests do not comply with these obligations, they are not entitled to a rent reduction because of these objectionable points.
2. House Rules
The guests are obliged to abide by the house rules.
3. Resignation
The guests are entitled to withdraw from the contract before the stay or the beginning of the rent. In case of such withdrawal, the host will claim compensation as follows:
- Full refund for cancellations made earlier than 5 days before the arrival date
- 50% refund for cancellations made 14 days to 5 days before the arrival date
- No refund for bookings made 5 days or less prior to arrival
4. Method of Payment and Conclusion of the Contract
The total rent and, if applicable, additional costs such as final cleaning fee are to be paid at the time of booking. The guest accommodation contract is concluded as soon as the apartment is booked.
5 Liability
Claims for damages are excluded regardless of the type of breach of duty, unless there is intentional or grossly negligent action. This also applies to tortious acts. In the event of a breach of material contractual obligations, the Consultant shall be liable for any negligence, but only up to the amount of the foreseeable damage.
6. Severability Clause
Should individual provisions of this contract be or become invalid in whole or in part, or should there be a loophole in the contract, this shall not affect the validity of the remaining provisions. In place of the invalid provision or to fill the gap, an appropriate provision shall be made which, as far as legally possible, comes as close as possible to what the contracting parties intended or would have intended according to the sense and purpose of this contract if they had considered the point.
7. Choice of Law
German law shall apply. The exclusive place of jurisdiction shall be the place of business.
